Insurance Compensation Consortium in Spain

With the eruption of the Cumbre Vieja volcano on the island of La Palma in the Canary Islands, more than 6000 people are currently affected and more than 1500 buildings have been destroyed. Unfortunately, many families have lost their homes, their memories and their lives. In these extraordinary situations it is the Insurance Compensation Consortium (Consorcio de compensación de seguros) that will cover the loss and damages. We have written this article to help you understand how it works and how to proceed if necessary.

What is the Insurance Compensation Consortium?

The Insurance Compensation Consortium (“consorcio de compensación de seguros CCS”) is a public body attached to the Ministry of the Economy, Industry and Competitiveness. Born in 1954, it has several missions including covering claims caused by extraordinary risks such as the Filomena storm or more recently the eruption of the volcano of La Palma.

What does the Insurance Compensation Consortium cover?

The consortium covers in 4 situations:

  1. Natural phenomena
  2. Extraordinary floods, earthquakes, tidal waves, volcanic eruptions, cyclonic storm….
  1. Violent phenomena

Damage resulting from acts of terrorism, rebellion, or popular uproar.

  1. Disasters caused by the armed forces

Damage caused by the Security Forces and Corps in peacetime and in an extraordinary manner

  1. Damage in the event of non-insurance

In the event that you have an accident without insurance or an extraordinary phenomenon occurs, the Insurance Compensation Consortium will also be responsible for the cost of the damage caused; in the case of home insurance, the Consortium will not be responsible for compensation.

Likewise, if you have a claim with a third party involved and the latter has no insurance, it will also be the Insurance Compensation Consortium which will initially assume the costs.

How does the insurance consortium work?

The Insurance Compensation Consortium receives a portion of the insurance premiums that customers pay to their insurer. This means that whenever you pay for your insurance, whether it is home, auto, life, or any other insurance that is not considered extraordinary risk, a portion of that amount goes to fund that entity. If you look at the details of your insurance policy, you will see the percentage that goes to the CCS. This is the surcharge on insurance for extraordinary risks for direct damage to people and property.

It is therefore a support for insurance companies, which would not be able to pay as much money in the event of an extraordinary event affecting a large number of policyholders.

How does the insurance consortium pay compensation?

Payment of compensation by the Insurance Compensation Consortium is made by bank transfer. Compensation will only be paid to beneficiaries of the insurance policy.

What is the indemnification period for the Insurance Compensation Consortium?

In accordance with what is established in the Law on Insurance Contracts (Ley de Contrato de Seguro) in Article 20.9, the insurance compensation consortium must make the payment of the compensation within a maximum of 3 months after the date of the claim.

What should I do to cover my claim?

You can declare your claim to the Consortium via its website by clicking here or by telephone (900 222 665 or 952 367 042) by submitting the corresponding request.

The following information must be sent to the organization:

  • Policy number and name of the insurance company
  • Bank details (IBAN)

Once the declaration has been made, an expert will be appointed to assess and quantify the damage. They will provide you with a reference number which will be sent to you by email or SMS.

Is there a deadline for reporting the claim to the Consorcio?

In order to report the claim and collect compensation, the CCS recommends contacting them as soon as possible. This allows the insurance consortium to assess the damage caused and speed up the process of paying compensation.

The recommended deadline is 7 days from the occurrence of the claim, although the consortium can accept claims submitted after this deadline.

What should I do if I disagree with the refusal of my claim?

Cover claims. This is the goal of any insurer. However, this goal is not always achieved by insurance companies. There are several ways to get back to your insurer if you disagree with them. Apart from the judicial route, there are three possibilities which are regulated in Spanish law:

Appoint an independent expert

This will be done at your expense. Provisions of art. 38 of the Insurance Contract Law (Ley de contrato de seguros). The insured has 40 days to appoint his own independent expert when he does not agree with the expertise of his insurance company. Once appointed and communicated to the other party, the company has 8 days to appoint an expert. The 2 experts may reach an agreement, but if not, they may appoint a third expert by consensus who will have 30 days to issue his report. This procedure is considered mandatory when the dispute is about the amount or the form of the compensation.

As a general rule, your insurance company must compensate you for the minimum amount within 40 days of the claim being reported. The Insurance Contracts Law (Ley de contrato de seguros) establishes the said condition "to make payment of the minimum amount of what the insurer may owe, according to the circumstances of which it is aware". Therefore, even if the adjuster's decision has been challenged, your insurer must have paid you this minimum amount, within the time limit set. If the expert's decision is not contested, the insurer will pay the amount of compensation indicated by the experts within five days. If it is contested, it will be necessary to wait for the resolution of the third expert.

Possibility of contacting the claims department of the insurance company if my claim is denied.

In Spanish, the department is called "Defensor del asegurado". The department is totally independent from the insurance company. The legal deadline for a response is 2 months. Nevertheless, the insurance companies try to process all the requests they receive quickly. In fact, 86% of the industry is committed to processing them within 30 days.

Making a claim to the Claims Department of the Directorate General of Insurance and Pension Plans (DGSFP)

The DGSFP can be contacted by various means, including by telematics. In order to contact this service, it is necessary to demonstrate that you have previously contacted the insurance company's complaints department (point 2). The maximum response time is 4 months.

Travelling with the coronavirus has become a real odyssey. Fear and the closure of the perimeter of several regions of Spain have led many travellers to prefer to postpone their visits or cancel flights already booked until the curve of this new wave drops. Many travel insurance companies have included COVID-19 in their coverage to reduce people's uncertainty about a possible contagion. However, the preventive PCR test before departure is excluded from the contract in travel insurance.

Does my travel insurance cover me if I contract COVID-19 during my trip?

Most travel insurances offer medical coverage in case of COVID-19 infection during a trip, covering medical expenses up to the limit indicated in the insurance contract. Coverage will include:

  • Diagnostic tests prescribed by medical professionals
  • Medical assistance
  • Hospitalization
  • Extension of stay in case the traveller has to be quarantined
  • Repatriation
  • Travel for an accompanying person in case of hospitalisation

If I become ill during the trip with symptoms consistent with COVID-19, does the insurance cover a PCR test?

If, during the trip, the traveller develops symptoms of COVID19, the necessary tests will be carried out for the diagnosis (including PCR) of this or any other disease. Always assessed and prescribed by a physician.

Hospitalization, if necessary, is also covered, as well as hotel accommodation if you do not require treatment in a health centre, but must remain in quarantine due to a diagnosis of COVID-19.

What happens if I travel to a destination where a COVID-19 test is required on arrival and I test positive?

The necessary medical assistance will be covered by most insurance companies, as well as the cost of extending the insured's stay in the hotel (in case of a COVID-19 diagnosis).

In case of an extension of your stay, you will be granted another return ticket in case you missed your initial return trip due to quarantine.

If I test positive for COVID during the trip, is my companion, who is also an insured, covered?

The repatriation of the companion to the place of origin is covered, as well as that of the insured.

What happens if I lose my return ticket because I was admitted to hospital or had to extend my stay in a hotel?

In case you lose your original return ticket because you have to stay in quarantine due to "COVID-19", the insurance companies will pay for the return tickets.

If a border closure or quarantine is imposed in the country of origin/destination of the trip, and I am unable to make my trip, is this covered?

At the moment, these circumstances are not included in most insurance contracts in Spain. However, we recommend that you check your insurance policy or contact your insurance broker to confirm coverage.

If I cannot return to my home country because the authorities in the destination country have ordered it, does the cover apply?

Yes, the travel extension cover is included in the insurance policy and up to the limit covered by the contract.

Can I cancel my trip if I am diagnosed with COVID-19?

If the insured is diagnosed with COVID-19 by a PCR test within 14 days prior to the trip departure, the insurance covers the cancellation costs in case of not being able to travel on the planned dates. You must have taken out cancellation cover when you purchased your travel insurance.

Is Workers' Compensation insurance compulsory in Spain?

Workers' Compensation insurance also called Work Accident Insurance or "seguro accidentes por convenio" in Spanish, is compulsory if it is required by the collective agreement ("convenio") in which the company's activity is included.

It is therefore important to know the collective agreement of the professional sector to which the company belongs. This is the document that shows the relationship between employees and employers, establishing the rights and obligations of the company and the workers. The collective agreements, which are concluded and renewed periodically, include, in some cases, a compulsory insurance that covers the compensation of possible accidents that employees may suffer in the course of their work. This is the compulsory conventional insurance "seguro de accidentes por convenio".

Why take out Work Accident insurance?

The purpose of this compulsory Work Accident insurance is to protect employees against possible accidents that may occur during the working day. Thus, in the event of death or disability following an accident at work, the insurance company will compensate the employee or beneficiaries.

What does this insurance cover?

The coverage of conventional insurance depends on the sector. The collective agreement determines the insurance obligations of the policy that the company must take out, detailing the guarantees, the minimum sum insured, the compensation in the event of an accident, etc.

The following coverage can be found in an "Accidentes por convenio" insurance contract:

  • Death
  • Permanent absolute disability
  • Total disability

What happens if the company does not have insurance in force?

Not having compulsory Workers' Compensation insurance can cause many problems for the employer. In fact, a claim or penalty may jeopardise the stability of the company.

The employer is responsible for the employees and must ensure that they carry out their activity in the best conditions of safety and prevention. Moreover, if the employer is obliged by the collective agreement to take out industrial accident insurance, he will be exposed to an administrative claim. Non-compliance with the obligations towards the employees can be considered as a very serious offence, punishable by large fines, which can go up to more than 150,000 euros.

If one of the employees suffers an accident at work and the company has not taken out insurance, the employer must bear the costs and compensation for the accident together with its assets. Depending on the coverage that each collective agreement establishes as compulsory, the amount to be paid for the claim can reach very high figures and jeopardise the financial situation of the company.

Taking out compulsory life or accident insurance should not be confused with membership of a "mutua de trabajo", responsible for providing health care in the event of an accident at work or occupational illness. It is linked to the Spanish social security system.

How much does this insurance cost?

The price of these insurances depends on various factors, such as the risk of the activity (a company in the construction or catering sector, has more risks than an office), the location of the company or the number of employees, which is usually a determining factor in the calculation of the insurance premium.

For an administrative activity, the cost is around 50 euros per year per employee.

What is business insurance?

The "Comercio" insurance is a type of insurance policy designed mainly for SMEs and offices. It is an insurance policy that covers compensation for damages related to the company's activity. It covers possible damage caused by the most common claims on the building and its contents:

  • Building  means the "walls" of a commercial premises, an office, a warehouse as well as all fixed water, gas, electricity installations...
  • Contents means  furniture, computer equipment, machinery and stocks.¡

The insurance includes civil liability in the event of claims by third parties as owner or tenant of the premises and for the activity carried out.¡

The Comercio insurance includes civil liability in the event of claims by third parties as owner or tenant of the premises and for the activity carried out.

What is the green card?

The "tarjeta/carta verde" or green card is a document to prove that the driver has adequate insurance cover ( third party liability insurance) for driving abroad.

What is it for?

This green card was designed to serve two purposes: to facilitate the movement of cars across international borders and to ensure that victims of accidents caused by foreign vehicles are not disadvantaged.

In which countries is the Green Card compulsory?

The countries are: Albania, Bosnia and Herzegovina, Belarus, Israel, Iran, Moldova, Montenegro, Morocco, Russia, the former Yugoslav Republic of Macedonia, Tunisia, Turkey, Ukraine .

Do I need the Green card to drive to UK, with Brexit?

The UK government has indicated that it is not compulsory to carry a "Green Card" (International Insurance Certificate). It is necessary to have any document issued by the insurer that proves the existence of compulsory insurance cover, whether it is the Green Card or another document, and it can be either in paper or electronic format. This document must contain the name of the insurer, the registration number to be insured, details of the insured vehicle (make/model), as well as the period of coverage.

What should I do if I have an accident abroad?

If you have an accident abroad, you will have to fill in an accident report. The model is the same in all European Union countries.

How do I get a Green Card?

In Spain, insurance companies are not legally obliged to issue the Green Card with the motor insurance policy. Despite this, there are insurance companies that provide it with the rest of the documentation when the insurance is taken out. However, you will have to apply to your insurance company every year, as the company will not send it to you automatically.

Note that: After many years of work initiated at the international level by OFESAUTO, the Council of National Offices (the international body that governs the format and structure of the "Green Card" document for the 48 countries that make it up) approved at its last General Assembly the decision to generate the document in PDF FORMAT so that it can be emailed to the insured and printed in black and white, in A4 format.

Circulation in Spain: what documents should you carry with you?

You should carry in your car  the following document to avoid having to pay a fine in the event of a police check:

  • Driving licence
  • Vehicle registration document ("permiso de circulación/logbook") and technical data sheet of the vehicle “ficha técnica”
  • Technical inspection (ITV ):  sticker on the front windscreen

Note that: Proof of payment of your insurance policy:

With the new regulations on civil liability of motor vehicles (Royal Decree 1507/2008, of 12 September BOE 13.9.2008), it is no longer obligatory to print the receipt of the insurance policy with the rest of the documentation, since police officers will check whether the vehicle is insured via a computer system called FIVA.

What coronavirus coverage do insurance companies offer?

Pandemics (such as the Covid19 pandemic) are excluded from health insurance policies, but insurance companies do offer support for public health on an exceptional basis. Therefore, patients who have symptoms and believe they are infected with this disease can call their private insurance for advice.

How do insurance companies cover COVID19?

DKV will care for its private clients with coronavirus symptoms according to the protocols established by the public system, testing for the disease if it is considered by a doctor. Any insured who presents symptoms of Covid-19 can call  the following number : 976 991 199 or contact the insurance company via the medical chat of the "Quiero cuidarme más" application. If hospitalization is recommended, the patient will be referred to a public hospital, and obtain coverage in a DKV center for further treatment.

  • Free telemedicine: under the slogan # MédicosFrenteAlCovid, several volunteer doctors will do an online consultation.

Antigen test

  • What is the antigen test?

Antigen tests detect the presence of the virus responsible for COVID-19 from a nasopharyngeal swab. Once the sample is taken, the professional applies it to the kit - and gets the result the same day.

  • How do I apply for the antigen test?

Through the smartphone application, "Quiero cuidarme más" Click on "Request for COVID-19 antigen test". In case the doctor prescribes the test, your prescription will appear in the "Health File", in the sub-folder "Tele-consultation", as well as a search engine by provinces where you can find the clinical analysis center to perform the test. You will also be able to request the test by clicking here.

PCR Test

  • The PCR test will be supported by DKV in the following cases:
    • If the doctor has made a written request for a test to assess the clinical symptoms of suspected COVID19 that the patient presents at the time of the visit.
    • If the request for PCR testing is not a preventive requirement for further examination, treatment or admission for another disease.
  • How do I request it?

Request it very easily through WhatsApp at +34 960 160 602. Remember to have the photo or image of the doctor's prescription handy. And you will receive an e-mail with the authorization to go to one of the agreed clinical analysis laboratories.

Axa specifies that its action against the coronavirus will follow the protocols set by public health institutions. Therefore, the company recommends to its clients with symptoms of covid-19 not to go to their health centers, but to first contact the service made available by the autonomous community. With regard to coronavirus detection tests, Axa performs PCR tests in case of symptoms and on medical prescription in case of surgical hospitalization and on medical criteria . In addition, the insurance company offers COVID19 tests at a more affordable price thanks to agreements with private laboratories.

However, in case of doubt or presentation of symptoms, the client can call the emergency telephone: 93 312 57 48, 24 hours a day to find out how to act.

Sanitas also wanted to reassure its customers and will continue to provide services in the event of symptoms caused by the coronavirus. In the event of symptoms, clients can call the emergency hotline: 91 752 29 02, 24 hours a day to find out what to do.

In addition, Sanitas also conducts coronavirus tests in the following cases:

    • Patients with symptoms who are hospitalized at Sanitas centers
    • Patients who present to Sanitas' emergency department with symptoms compatible with coronavirus
    • patients who are going to have a surgery, childbirth, caesarean section

The company also provides free rapid antigenic tests (to find out if he is infected at that time) to all its insured clients who have health insurance and who have been in close contact with a case of covid-19 within the last seven days.

No medical prescription is required for this test, but the insured person must request it by making an appointment in advance at one of the Sanitas centers. The results of this test can be consulted within 24 hours via the My Sanitas application, by telephone or by visiting the center concerned.

 

ADESLAS  Adeslas logo

SegurCaixa Adeslas covers detection tests (PCR and antigenic tests) for all its insured who present suspicious or compatible symptoms of the disease and who have been previously evaluated by a doctor and present a medical prescription. They also cover in case of surgical hospitalization and on the medical criteria of the clinic.

For all other cases not covered, Adeslas offers the possibility of carrying out these tests at special prices in a selection of health centers, (list available by clicking here).

In addition, Adeslas offers to its clients  a follow-up service for coronavirus patients with mild symptoms for whom home isolation has been prescribed. This service consists of a continuous evaluation of the disease offering the patient therapeutic advice and protective measures for himself and his family.  In addition, they also offer an accompaniment service for people living alone or in a more vulnerable situation. Adeslas also has a 24-hour telephone for any consultation regarding the Coronavirus: 93 259 34 16.

Asisa is another of the insurers that will cover coronavirus always following the protocols and instructions of the public health institutions. Therefore, Asisa makes its emergency telephone number available to people with coronavirus symptoms: 900 900 118.  However, with regard to covid-19 tests, Asisa specifies that they will not be carried out unless symptoms are present and that in any case a medical prescription is necessary.

It is also important to consult the references of other users and to be well informed about the availability of doctors, the frequency of consultations and waiting times in the medical centres.

What are the main specialties included in the medical network?

General medicine, dermatologists, gynecologists, cardiologists, psychologists, psychiatrists, traumatologists, physiotherapists, clinical analyzes, radiology, hospitalization, home emergencies….

However, there is a variety of professionals available to you, so it is worth consulting with the insurance company’s medical cadre and focusing on the services available to you in the province you are in.

How to choose the insurance company?

Consultation with the medical network is an essential part of the medical assistance process covered by health insurance. You will be able to check both the list of medical centres and specialists, as well as hospitals and clinics.

Depending on the province, there may be certain companies that are more or less well represented.

In large cities such as Barcelona or Madrid, Axa is the most represented company. In the province of Alicante, most health professionals are affiliated to DKV.

It is recommended that you use an insurance broker who can recommend a health insurance contract that will meet your needs.

What other types of insurance are available?

The medical network insurance is not the only formula that you will be able to subscribe. There are other types of insurance policies that you can also take out from your insurance company:

  • Medical insurance with “copagos” deductible: these insurances offer identical cover to that with a medical framework, but with a lower premium. In return, 100% of the service you receive will not be covered, so you will have to pay a portion “copago”  each time you go for a consultation or medical intervention. This type of insurance is more appropriate if you do not go to doctors or specialists regularly.
  • Insurance with medical network and reimbursements: this insurance allows you to go to medical centers, clinics and specialists not covered by your insurance company. After paying for your service, you will have to request reimbursement and the company will reimburse you 80% of the invoice (limits and ceiling to be confirmed with your contract)
  • Non-hospital medical insurance: this policy does not include the hospitalization service or surgical interventions in clinics, hospitals and health centers, but includes consultations with doctors and specialists and diagnostic tests.

Community Insurance in Spain: All you need to know in 6 questions

Communities of property owners and building is exposed every day to multiple risks which require the availability of urgent and necessary services to face them. It is therefore important to take out insurance, called in Spanish “seguro de comunidad” for the peace of mind of all neighbors.

What does Community insurance cover?

Community insurance (also called communities and buildings insurance) covers risks which damage the habilitability and confort which all comunities must provider to ther owners and families.

The insurance protects the common parts of a building and the civil liability of the co-ownership.

Is Community insurance compulsory in Spain?

In Spain, communities and building insurance is not compulsory at national level, although it is strongly recommended. According to the Horizontal Property Law (LPH):

Art 9: “it is necessary to have a reserve fund; an annual sum to cover conservation and repair work on the building or work resulting from fires or floods. ”

With the reserve fund, the co-ownership can sign an insurance contract covering the common parts. Although at the state level no law requires it, there are specific regulations in some provinces as Madrid and Valencia.

Does Communities and building insurance cover my apartment?

No, the community insurance ("seguro de comunidad" in Spanish) does not cover damage to your flat. For this, you must take out a home insurance policy. You can request a quote by clicking here

The communities and building insurance will cover claims in the common areas. Your home insurance will cover damage to your personal content and your liability insurance.

Is water damage covered by the Community insurance?

As a rule, most insurance companies include water damage caused by water mains in their basic coverage. Coverage for private pipes is optional.

What are the main covers?

The basic covers are as follows:

  • Civil liability: for damage that may be caused to third parties (for example: slippery staircase, falling tile causing damage to a third party, etc.)
  • Material damage, such as fire, explosion, lightning or atmospheric phenomena,
  • Water damage
  • Communities assistance: include a 24/7 assistance service, 365 days a year
  • Pest control, fumigation and disinfection services: 1 full service / year (with revision every 6 months) to eradicate the proliferation of cockroaches, moths, rats, etc., in the various common áreas.
  • Unblocking communal pipes
  • Glass breakage or mirrors in common áreas
  • Legal defense

Who should subscribe the  community insurance?

It is the Communities of property owners and building which must take out the insurance "Comunidad". If in the statutes of the community established that the subscription of an insurance policy is compulsory, any owner may require that it be taken out by community.

How much does the Communities and building insurance insurance cost?

The insurance premium varies depending on the optional cover included but it can vary between 70 and 150 euros per year and per accommodation.

Construction insurance in Spain: how to choose the right one?

Construction insurance in Spain: How to choose the right one?

Julia Jannin,  Managing Director at Inov Expat, helps us to better understand how insurance that protects construction in Spain works.

Three legal obligations

In Spain, the construction sector is regulated by the LOE (Ley de ordenación de la Edificación) of 5/11/1999.

This law consists in making the various stakeholders and actors of a yard accountable, by imposing on them three guarantee obligations (commitment). The first one is subject to compulsory insurance: Decennial insurance. The second is optionally insurable: “Seguro trienal” insurance, it comes in addition to decennial insurance. However, there is no insurance for the third: Manufacturer's warranty, in the event of a claim, the manufacturer will have to pay the costs himself. These three legal obligations have a duration in time:

Construction insurance

Decennial insurance (COMPULSORY)

Decennial insurance is mandatory for the constructor in the case of new constructions where the work affects the structure of a building.

Example of a claim covered by Decennial insurance : once the work has been carried out, significant cracks appear on the walls of a house. These filtrations are due to a foundation wich unsuit the nature of the soil.

It has been mandatory in Spain since May 6, 2000.

The insured capital is the total cost of the yard, including the fees of all those involved in the site, licenses and taxes.

 

The insurance "seguro trienal"

In order to be fully insured, the “seguro trienal” insurance must be included to be covered for 3 years on the issues of:

  • Waterproofing of roofs and terraces
  • Waterproofing of facades
  • Secondary works and installations

So, there are two insurances which cover the legal obligations of engagement, and only one of the two is legally obligatory. However, this is not the only mandatory insurance on construction sites. Indeed, there are two other insurances that the developer must take out: 

Insurance collective accidents (COMPULSORY)

The collective agreement makes it mandatory to take out Accident insurance in order to cover work accidents that could occur on the site.

The delivery guarantee (COMPULSORY)

The developer must take out this insurance in order to protect the consumer from bad works. It can occur in many cases such as a construction delay, a bankruptcy filing, a price overrun, etc.

Finally, there are two complementary insurances that are not mandatory for the promoter:

 

Civil liability insurance

Please note that professional civil liability is not mandatory in the construction industry except for architects, engineers and yard managers. It is of course highly recommended.

 

All-risk construction site insurance 

This insurance is essential to cover damage against accidental risks affecting a construction site. The main guarantees are theft of materials, fire, meteorological phenomena (flood, lightning, water damage, etc.), negligence and design errors.
